Terms and conditions of sale
The terms that apply when you buy decor, party and catering equipment from us in South Africa.
1. Who we are
These terms govern every quote, order and sale between Novelty Decor, trading from 33 voorloper Cres, Mossel Bay, South Africa 6500, South Africa, and you as the customer. Placing an order or accepting a quote means you accept these terms.
2. Quotes
Written quotes are valid for 7 calendar days unless stated otherwise. Quotes are subject to stock availability and to supplier and exchange-rate movements, which can affect imported equipment. A quote is not a reservation of stock; stock is allocated on receipt of payment.
3. Prices and VAT
All prices are shown in South African Rand (ZAR) and include VAT at the prevailing rate where applicable. Delivery, installation, off-loading and specialised handling are quoted separately per order. We correct obvious pricing or specification errors and will contact you before processing an affected order.
4. Orders and acceptance
An order is only accepted once we confirm it in writing by email or WhatsApp. We may decline or cancel an order where stock is unavailable, where a price error occurred, or where payment cannot be verified. Any refund in these cases is paid in full.
5. Payment
Unless we have agreed credit terms in writing, payment is required in full before delivery or collection. We accept EFT and the payment methods confirmed on your invoice. Please use your invoice number as the payment reference and send proof of payment so we can release your order.
6. Ownership and risk
Ownership of the goods passes to you only once payment reflects in full in our account. Risk in the goods passes to you on delivery to your premises or on collection, whichever happens first.
7. Delivery and lead times
We deliver throughout South Africa. Lead times are estimates given in good faith and depend on supplier stock and carrier schedules; they are not guaranteed dates. Someone must be available at the delivery address to receive, inspect and off-load the goods. Storage, re-delivery or waiting-time charges may apply to failed deliveries.
8. Site readiness and installation
You are responsible for access, floor loading, ventilation, drainage, gas and electrical supply at your site. Electrical and gas connections must be done by a suitably qualified South African contractor. Damage or failure caused by incorrect installation, voltage fluctuation or inadequate site conditions is not covered.
9. Warranty
Equipment carries the manufacturer or supplier warranty applicable to that item, in addition to your statutory rights. Warranties cover manufacturing defects under normal commercial use and exclude wear parts, consumables, misuse, neglect and unauthorised repairs. See the warranty page for detail.
10. Cancellations and returns
Cancellations before dispatch are refunded in full, less any bank or supplier charges already incurred. Special-order and custom items cannot be cancelled once placed with the supplier. Returns are handled under our returns and refunds policy.
11. Product information
Images, dimensions, capacities and specifications are supplied by manufacturers and are indicative. Suppliers may improve or change specifications without notice. Confirm any critical dimension or electrical requirement with us in writing before ordering.
12. Limitation of liability
To the fullest extent permitted by South African law, our liability arising from any order is limited to the purchase price of the affected goods. We are not liable for indirect or consequential loss, including loss of profit, loss of stock or business interruption. Nothing in these terms limits your rights under the Consumer Protection Act 68 of 2008.
13. Consumer rights
Nothing in these terms is intended to waive or limit any right you have under the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002. Where a clause conflicts with those Acts, the Acts prevail.
14. Governing law and disputes
These terms are governed by the laws of the Republic of South Africa. Please raise any dispute with us first so we can resolve it. Unresolved disputes may be referred to the Consumer Goods and Services Ombud, the National Consumer Commission or a South African court of competent jurisdiction.
15. Changes to these terms
We may update these terms from time to time. The version published on this page at the time you place your order applies to that order.
